Final paycheck calculator: when your last pay is due in New York
Updated By The editorial teamNot reviewed by an attorney — based on the official sources below
In short
New York doesn't require final pay on your last day, but it does require it no later than the regular payday for the pay period in which your job ended — whether you quit or were fired (Labor Law § 191(3)). Enter your last day, one recent payday and how often you're paid to see the date.
Read on for the details, the exceptions and the sources.
How we calculate
- Your pay schedule is projected from a payday you know (weekly, every two weeks, twice a month or monthly).
- The first regular payday on or after your last day is shown as the date final wages are due under Labor Law § 191(3).
What the calculation leaves out
- Employers that pay in arrears, where the payday covering your last period may come later — check your stubs.
- Accrued vacation pay, which depends on the employer's written policy.
- Commissions and bonuses under separate agreements.
What to do with the result
- If the date passes without pay, ask in writing.
- File a wage claim with the NYS Department of Labor.
- Keep pay stubs, your schedule and any termination message.

Frequently asked questions
Does it matter if I quit instead of being fired?
No. Labor Law § 191(3) covers any termination of employment.
Is my unused vacation time owed?
It depends on the employer's written policy; if the policy doesn't say vacation is forfeited, it may be owed (Labor Law § 198-c).
