New York minimum wage and overtime calculator
Updated By The editorial teamNot reviewed by an attorney — based on the official sources below
In short
Enter where you work, your hourly rate and the hours you worked in a week. The calculator applies New York's minimum wage for your region (Labor Law § 652) and time-and-a-half for hours over 40, and shows the minimum gross pay the law requires for that week — and any shortfall.
Read on for the details, the exceptions and the sources.
How we calculate
- The minimum hourly wage for your region and year comes from Labor Law § 652(1-a): $17.00 in New York City, Nassau, Suffolk and Westchester and $16.00 in the rest of the state from January 1, 2026 ($16.50 / $15.50 in 2025).
- Your required hourly rate is the higher of your actual rate and the minimum wage.
- Hours up to 40 in the workweek are paid at that rate; hours over 40 at 1.5 times it.
- The result is the minimum gross pay for the week, before taxes and lawful deductions.
What the calculation leaves out
- Special rates and tip credits for tipped food-service and service workers, home care aides, farmworkers and other covered groups.
- Exempt (salaried executive, administrative or professional) employees, who may not be owed overtime.
- Spread-of-hours and call-in pay, and any higher rate in your contract or union agreement.
- Rates for 2027 onward, which the Commissioner of Labor sets each year.
What to do with the result
- If you were paid less, keep your pay stubs and a record of your hours.
- Ask your employer in writing to correct it.
- File a wage claim with the NYS Department of Labor, or sue — Labor Law wage claims can go back six years.

How we calculated
| Where you work | New York City |
|---|---|
| Minimum wage (2026) | $17.00 an hour — Labor Law § 652(1-a) |
| Your hourly rate | $17.00 |
| Hourly rate the law requires | $17.00 |
| Regular hours (up to 40) | 40 × $17.00 = $680.00 |
| Overtime hours (over 40) | 5 × $25.50 (1.5 × $17.00) = $127.50 |
| Minimum gross pay for the week | $807.50 |
- Non-exempt employees are owed 1.5 times their regular rate for hours over 40 in a workweek (overtime under federal law and New York's minimum wage order).
- Tipped food-service workers, home care aides, farmworkers and some other groups have special rules and rates; this calculator does not cover them.
- From 2027 the rates are adjusted each year by the Commissioner of Labor; check dol.ny.gov for the current figure.
- This is gross pay before taxes and lawful deductions.
Frequently asked questions
Does the minimum wage depend on how big my employer is?
Not any more. Since 2024 the New York rates in Labor Law § 652(1-a) apply to every employer regardless of size, and differ only by region.
Am I owed overtime if I'm on salary?
Not automatically excluded: salaried workers are owed overtime unless they meet an exemption, which depends on both duties and a minimum salary. A salary alone doesn't make you exempt.
